Our approach to Privacy

This Privacy Policy applies to the collection, use, disclosure and handling of personal information by Innova Legal and its associated entities (collectively referred to as “we” or “us”), including personal information collected via our www.innovalegal.com.au website (the “Website”).

We may also, if you consent, collect personal information about you from another related entity, from publicly available sources of information, or in some cases, from third parties including recruitment agencies, previous employers, government departments (eg Department of Immigration and Border Protection) and third party service providers which provide criminal, bankruptcy and other checks.

 

The personal information we collect about you may include (but may not be limited to) your name, date and place of birth, contact details, Internet Protocol (IP) address, occupation and education/work history, employer, legal and industry areas of interest, passport details and information relating to your dealings with us and our clients.

 

We may also collect sensitive information about you, including health information and criminal background checks.

 

Why we collect your personal information

  • contacting you (including via electronic messaging such as SMS and email, by mail, by phone or in any other lawful manner);

  • providing you with legal services or legal information;

  • undertaking conflict searches for our own purposes and the purpose of determining if we can represent a client or potential client;

  • acting for a client when it acquires a business with employees;

  • acting for a client in litigation against an individual;

  • acting for a client in a matter against an individual (eg an employment matter); and

  • developing and improving our services and obtaining feedback.

 

If we are not able to collect personal information about you we may not be able to provide you with products, services and assistance to the extent that they require us to collect, use or disclose personal information.

  • our clients, where we have collected your personal information for the purposes of providing services to our clients;

  • barristers, legal consultants and other specialists in relation to your matter;

  • our suppliers, contractors and agents from time to time that provide services to us or help us to provide and market our services to you;

  • specific third parties authorised by you to receive information held by us; and

  • other persons, including government agencies, regulatory bodies, law enforcement agencies and courts and as otherwise required or authorised by law.

 

While we aim to use services and instances that are located in Australia, some of these suppliers and other parties may receive, access, process, host or store your information in overseas locations. This includes the United Kingdom, United States of America and the European Union. For example, we may disclose your email address or other contact information to providers of electronic execution services, which may store the information in an overseas jurisdiction.

 

Using our Website, Electronic Messages and Cookies

 

We may collect, use and store information about your use of our website, such as which pages you visit, the time and date of your visit and the IP (internet protocol) or MAC (media access control) address assigned to your device.

This information is used to improve the services we offer you, for statistical, website development and functionality purposes, and for complying with our CPD reporting obligations.

How We Store and Keep Your Information Secure

For example, we restrict physical access to our offices, employ firewalls, secure databases, password protect our IT systems, frequently update our anti-virus software, use cyber security services and conduct regular audit and data integrity checks. All of our employees are also bound to keep your personal information secure and treat it as confidential.

However, we cannot guarantee the security of your personal information. The internet is not a secure environment. If you do use the internet to send us any information, including your email address, please be aware that it will be sent at your own risk.

Unless expressly stated otherwise, Allens is not responsible for the privacy practices or the content of those linked websites. The privacy policies that apply to those other websites may differ from our privacy policy, so we encourage individuals to read them before using those websites.

We will update, retain and delete your data in accordance with our policies and procedures, applicable laws and, where applicable, your instructions.

Accessing or correcting your personal information

You have rights under the Privacy Act and Spam Act 2003 (Cth) to:

  • request access to personal information we hold about you;

  • ask us to update or correct any information that is inaccurate, incomplete or outdated; and

  • opt out of receiving direct marketing communications from us.

 

You can do any of these things by contacting us using the contact details below.

If you request access to your personal information or ask us to correct or update information about you, we may need to verify your identity. In some circumstances, there may be a valid reason for us to deny your request to access or correct your information. If we do this, we will tell you why.

Making a complaint

 

If you have any questions or concerns about our collection, use or disclosure of personal information, or if you believe that we have not complied with this Privacy Policy or the Act, you can contact us using the details set out below. Please include your name, email address and telephone number and clearly describe your complaint.

Any complaint will be investigated and a a determination will be made as to  whether a breach has occurred and what action, if any, to take. We will take any privacy complaint seriously. We will aim to resolve any such complaint in a timely and efficient manner, and our target response time is 30 days. We request that you cooperate with us during this process and provide us with relevant information we may require.

If you are not satisfied with the outcome of any internal investigation we conduct, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at enquiries@oaic.gov.au or on 1300 363 992.
